1. Acceptance of These Terms

These Terms of Service (“Terms”) govern your use of DinkFlow, operated by 3i7 LLC (United States). By accessing or using DinkFlow, you agree to these Terms and to any policies linked from them, including the Privacy Policy and Content Policy .

If you do not agree to these Terms, do not use DinkFlow.

2. Scope

These Terms apply to DinkFlow websites, pages, tools, apps, and community features under dinkflow.com, including the blog, Paddle Tuner, Paddle Studio, Pickleball IQ, community profiles, messages, comments, support surfaces, and related features.

3. Eligibility

You must be at least 13 years old to use DinkFlow. By using the service, you confirm that you meet this age requirement and that your use complies with applicable laws.

4. Accounts and Account Security

Some features require an account. You are responsible for the activity on your account and for keeping your login credentials secure. If you believe your account has been compromised, contact us promptly at gpts-support@proton.me .

We may restrict, suspend, or terminate accounts that violate these Terms, the Content Policy, or applicable law.

5. User Content

You retain ownership of content you submit, post, upload, or otherwise make available through DinkFlow, including paddle setups, comments, messages, profile information, support posts, and other user-generated content (“User Content”).

By submitting User Content, you grant DinkFlow and 3i7 LLC a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, publish, adapt, moderate, and distribute that content as needed to operate, improve, protect, and promote the service. This license ends when you delete your content or your account is removed, subject to reasonable technical limits such as backups, caches, search indexing, audit needs, and community anonymization described in the Privacy Policy and Content Policy.

You are responsible for your User Content and for ensuring that you have the rights needed to post it. Do not post content that infringes another party’s rights or violates the Content Policy .

6. Acceptable Use

You agree not to misuse DinkFlow. This includes, without limitation:

  • Breaking the law or encouraging unlawful activity.
  • Harassing, abusing, impersonating, or misleading others.
  • Posting spam, scams, malware, deceptive links, or infringing content.
  • Sharing another person’s private information without consent.
  • Attempting to bypass security, rate limits, moderation, access controls, or service restrictions.
  • Interfering with the operation, reliability, or integrity of DinkFlow.

The Content Policy provides additional community rules and moderation standards.

7. Informational Content, Pickleball, and Safety

DinkFlow provides pickleball learning, gear, paddle tuning, community, and related informational content. DinkFlow is not medical advice, legal advice, professional coaching, manufacturer guidance, tournament-rule certification, or a substitute for advice from qualified professionals.

Pickleball, exercise, equipment changes, paddle modifications, training, warmups, and injury-related decisions involve risk. You are responsible for your own play, equipment choices, health decisions, rule compliance, and safety. Consult a qualified medical professional before acting on injury, pain, recovery, or exercise information, and follow applicable manufacturer, facility, league, and tournament rules.

8. Automated and AI-Assisted Features

DinkFlow may use automated systems or AI-assisted features to generate, organize, summarize, score, recommend, moderate, or display information. Automated outputs can be incomplete, inaccurate, outdated, or inappropriate for your circumstances. You are responsible for reviewing and verifying any output before relying on it.

9. Paid Services

DinkFlow may offer paid products, subscriptions, purchases, or premium features in the future. If paid services are offered, the price, billing period, cancellation terms, renewal terms, refund rules, and any additional purchase terms will be posted at checkout or in the relevant product flow.

Unless otherwise stated in the applicable purchase terms, fees are charged in the currency shown at checkout and may be processed by third-party payment providers. You are responsible for taxes, charges, and account information associated with your purchases.

DinkFlow may link to or integrate with third-party services, including authentication providers, analytics providers, cloud infrastructure, social platforms, video platforms, payment providers, and external websites. Third-party services are governed by their own terms and privacy policies. DinkFlow is not responsible for third-party content, policies, availability, or practices.

11. Service Changes and Availability

We may change, suspend, discontinue, limit, or remove features at any time. We may also remove content, restrict access, or take action needed to protect users, the service, or the public.

We try to keep DinkFlow useful and reliable, but we do not guarantee that every feature will always be available, uninterrupted, secure, or error-free.

12. No Warranties

DinkFlow is provided “as is” and “as available.” To the fullest extent permitted by law, 3i7 LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and reliability.

13. Limitation of Liability

To the fullest extent permitted by law, 3i7 LLC and its owners, operators, affiliates, service providers, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, personal injury, equipment damage, loss of goodwill, or service interruption arising from or related to your use of DinkFlow.

To the fullest extent permitted by law, the total liability of 3i7 LLC for any claim arising from or related to DinkFlow will not exceed the greater of: (a) the amount you paid to DinkFlow for the service giving rise to the claim in the 12 months before the claim, or (b) $100.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

14. Indemnity

You agree to defend, indemnify, and hold harmless 3i7 LLC and its owners, operators, affiliates, service providers, and agents from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or related to your use of DinkFlow, your User Content, your violation of these Terms, or your violation of another party’s rights.

15. Governing Law

These Terms are governed by the laws of the State of California and the United States, without regard to conflict-of-law rules.

16. Arbitration and Class-Action Waiver

Before filing a claim, you agree to contact us at gpts-support@proton.me and try to resolve the dispute informally. If the dispute is not resolved within 30 days, either party may begin arbitration.

Except for claims that may be brought in small claims court or claims seeking injunctive relief for intellectual property misuse, any dispute arising from or related to these Terms or DinkFlow will be resolved by binding individual arbitration, rather than in court. You and 3i7 LLC waive the right to a jury trial and the right to participate in a class action, class arbitration, private attorney general action, or other representative proceeding.

Arbitration will take place in California unless the parties agree otherwise, and will be conducted by a neutral arbitrator under the rules of a recognized arbitration provider. If this arbitration section is found unenforceable in whole or in part, the unenforceable portion will be severed and the remaining Terms will continue to apply.

17. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the date above. For material changes, we may provide additional notice on the site or in the app. Your continued use of DinkFlow after changes become effective means you accept the updated Terms.
